Acceptance of Terms

By accessing or using Kilala ("the Service"), operated at kilala.ai, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

Service Description

Kilala is a digital business card platform that allows you to create, customize, and share professional business cards online. The Service includes card creation and design tools, QR code and link sharing, card view analytics, product usage analytics, lead capture features, and subscription management.

User Accounts

To use Kilala, you must create an account through our authentication provider, Clerk. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate, current, and complete information. You must be at least 13 years old to use the Service.

Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Impersonate another person or entity on your business card
• Upload malicious content, viruses, or harmful code
• Attempt to gain unauthorized access to the Service or its systems
• Use the Service to send spam or unsolicited communications
• Interfere with or disrupt the Service or servers connected to it

We reserve the right to suspend or terminate accounts that violate these terms.

Intellectual Property

You retain ownership of all content you upload to Kilala, including text, photos, logos, and other materials. By uploading content, you grant Kilala a non-exclusive, worldwide license to display that content as part of your business card and the Service.

The Kilala name, logo, and Service design are the property of Kilala. You may not copy, modify, or distribute our branding without written permission.

Payments and Subscriptions

Kilala offers a free plan and paid Premium subscriptions. Payment processing is handled by Polar.sh.

• Subscription fees are billed in advance on a monthly or annual basis
• You may cancel your subscription at any time; access continues until the end of the current billing period
• Refunds are handled according to Polar.sh's refund policy
• We reserve the right to change pricing with reasonable notice

Free Plan Limitations

The free plan includes up to 100 card views. After exceeding this limit, your card remains visible but enters a grace period with upgrade reminders. We do not block or remove your card for exceeding the free view limit.

Termination

You may delete your account at any time. We may suspend or terminate your account if you violate these Terms of Service. Upon termination, all your data — including business cards, analytics, and leads — will be permanently deleted.

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

Limitation of Liability

To the maximum extent permitted by law, Kilala shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, revenue, or business opportunities.

Indemnification

You agree to indemnify and hold harmless Kilala from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

Changes to These Terms

We may update these Terms of Service from time to time. We will notify you of material changes by posting the new terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the new terms.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Guatemala, without regard to conflict of law provisions.
